Our Guarantee: Lake Country Cakes will provide a professionally decorated dessert in a timely manner as specified in the invoice or contract. We appreciate your business and we are honored that you have chosen us for your special celebration. We guarantee that the flavors, size, and general design elements will be met as outlined. If you are not satisfied with our product(s) please let us know at the time you receive your order. Once your order is accepted, refunds will not be considered.
INGREDIENTS: All cakes, fillings and icings may contain, or come into contact with, soy, wheat, dairy, nuts or other allergens. It is the responsibility of the customer to inform me prior to the confirmation of their booking of any allergy issues. It is the responsibility of the Customer to inform their guests of all allergy information and accordingly the Supplier will not be held liable for any allergic reaction resulting from consumption of the cake. All products are made to be eaten on the day of the celebration.
QUOTES: All quotations are valid for 7 days from the date of issue, if you place your order after the 7 days, the quotes are no longer valid and total may increase based on several factors.
ORDERS: We prefer at least seven (7) days notice for all orders, as we are continually booked in advance. We will however endeavor, where availability permits accept short notice cakes. If we are able to do a cake on short notice there will be a rush order fee. 4 days notice is subject to a 35% fee. 2-3 days notice is subject to 50% fee and 1 day notice is double the price.
Inspiration Photos: Any Products ordered from a picture or photo of a product produced by any other cake maker, can only be reproduced by us as our interpretation of that product and will NOT be an exact reproduction of the product in the picture or photo. We do not copy other peoples work but we can be inspired by it and make it our own.
Design Variations: Although we make every attempt to provide an exact design and to match colors, custom cakes are a work of art. It may not be possible to match an exact shade of a color, but we will come as close as possible. The final product may be subject to slight variations. Also be aware the exposure to light can cause colors to change. We do not offer discounts or refunds if the exact shade of a color is not achieved or if a variation occurs due to lighting. In the event that a major variation needs to be made Lake Country Cakes will communicate this to the customer and seek re-design approval.
DEPOSITS: Your deposit is due no later than 7 days before your pick up if there is still availability. Failure to pay the deposit results in your order being canceled or even your spot being taken by someone else. Deposits are in place to also save your spot because we can only fulfill a certain amount of orders per day. We cannot guarantee you a spot unless you pay your deposit. If you had made an order but haven't sent the deposit yet and we are almost booked, we will reach out to you first before accepting more orders, if we do not receive a deposit within 24 hours your spot will be given to someone else.
Refunds: Lake Country Cakes will not offer refunds or exchanges for custom products that meet our quality standards once a cake has been picked up/delivered and “Accepted” by you or another designated party. All online orders though our website are FINAL and no refunds will be issued. Where we have prepared what is quoted and invoiced, but the customer does not accept the finished product, the deposit WILL NOT be refunded due to decorating style, color shade or general decoration design. We only give refunds if the product does not meet the flavor or size desired. The customer can choose to pay the remainder and take the product/s, or leave them at no extra cost. Cake flavor and texture is subjective. Refunds requested due to flavor or texture after cake has been accepted and picked up will be at the sole discretion of Lake Country Cakes. We may consider a store credit if the product is brought back to us and the quality of the cake flavor or texture is determined not to meet our standards within 24 hours of your event. Please note, we do taste our cakes daily to insure the highest quality. Quality determination is solely at the discretion of Lake Country Cakes. Our cakes need to be kept out at room temperature for at least an hour prior to serving. Keep in mind, variety in temperature and humidity may impact the flavor, overall design, or texture of the cake to some degree. Please understand we cannot control changes in texture or changes in color or shape due to weather conditions.
Unforeseen Circumstances by Lake Country Cakes: If for any reason Lake Country Cakes has to cancel your order due to Illness, Emergency, ect. Your deposit/full payment will be refunded.
Cancelling Orders: If a customer has to cancel an order with 7 days+ notice, a full refund will be issued. If a customer has to cancel an order with 6-3 days notice we will not give a cash refund, but will give order credits for future orders. If a customer has to cancel an order with 0-2 days notice will not be credited or refunded.
FINAL BALANCE PAYMENTS AND PICKUPS : The balance is due on or before pickup date, and BEFORE the product leaves the premises. If you are paying cash, then exact change is appreciated as we do not carry change. If you do not pay for your order you will not be able to take your items with you and are subject to being banned from ordering anything else from Lake Country Cakes depending on the situation.
Leaving the Premises: If you are leaving the premises with your products you are saying that they meet your standards and nothing is wrong with them visually and the products are in tact. Once they leave Lake Country Cakes we are NOT responsible for any damage done to the products. If you are having someone else come pick up the product, the same rules apply and we cannot be responsible for anything that happens to the product once it has left our premises. There will be no refunds for damaged products.
Late Pick Up Policy: Our time is valuable! If you know you're not going to make your pick up time you MUST contact us, we may not be available anymore until a different time. If you are 30 minutes late for pick up without contacting Lake Country Cakes a $10 fee per every 30 minutes you are late will be charged. If you contact us saying you are not able to come at designated time, we have the right to reschedule your pick up time.
Delivery Terms: The delivery time will be confirmed before your event date. Cakes maybe setup 1-3 hours before your event. For outdoor events, we try to setup as close to the reception time as possible, which may limit design options. The Client must disclose any adverse road hazards and/or obstacles that may hamper the delivery and quality of finished products. In the case of an unavoidable occurrence, such as an act of god, a car accident, poor road conditions, or dropping of cake during delivery Lake Country Cakes cannot be held liable for more than the price of the cake described in this order. If the client or client representative is not available to receive the delivery. A re-delivery fee will be required at the time of receipt of goods and services.
Photographs and Marketing: We respect the privacy of all our clients. We will not disclose the identity of clients (photographs of people, last names, event details, contract details) without permission. We do however, reserve the right to photograph baked goods and use those photos on our website, social media, or marketing materials. We also reserve the right to use any photographs for display or promotion without compensation to you.
Governing Law and Waiver of Jury Trial: This Agreement shall be subject to and governed by the laws of the Commonwealth of Wisconsin irrespective of the choice of law rules in the state of execution of the Agreement. The parties hereto acknowledge and agree that, any legal action brought pursuant to this Agreement shall only be of proper venue exclusively within the courts of the Commonwealth of Wisconsin . Any litigation relating to this Agreement, brought by Client shall be commenced and maintained only in a federal or Virginia state court located nearest to Company’s principal office; The Client consents to personal jurisdiction and venue in any such court. EACH PARTY, TO THE FULLEST EXTENT PERMITTED BY LAW, HEREBY IRREVOCABLY WAIVES ALL RIGHT TO TRIAL BY JURY AS TO ANY ISSUE RELATING HERETO IN ANY ACTION, PROCEEDING OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT OR ANY OTHER MATTERS INVOLVING THE PARTIES HERETO. If Company is the prevailing party, it shall be entitled to recover from the Client the reasonable costs and expenses incurred in connection with any mediation, suit or other action brought pursuant to this Agreement, including, without limitation, reasonable attorney’s fees.
